1. ACCEPTANCE AND DESCRIPTION OF SERVICES
Your continuing use of Lease by Designs services, is subject to the following terms of service. Lease by Design reserves the right to update and change the Terms at any time without notice. A violation of any of the Terms below may result in action by Lease by Design up to and potentially including the termination of your account and access to our Services, with or without warning.
Lease by Design is a private service offered by Shallow Pocket Web Design which provides website for rent/lease and related services, including website development, editing, hosting. You may be required to provide current and up to date personal information , including a valid email address. As a client to Lease by Design, you understand that you may receive some amount of direct and indirect communications from us, such as service announcements, and administrative messages.
2. CANCELLATION AND TERMINATION
Lease by Design reserves the right to cancel any Clients Services for any reason or no reason at all. Lease by Design provides web hosting to websites that abide by our Terms. If you or Lease by Design cancel your Services, cancellation will immediately stop all Services. You will no longer have access to your website and all associated information may be deleted by Lease by Design. You are entirely liable for all activities conducted through your account.
3. CONTENT, CONDUCT RULES AND OBLIGATIONS
You understand you bear the risk associated with, the accuracy, completeness or usefulness of any Content. Lease by Design reserves the right to prohibit Content which is deemed in Lease by Design sole discretion harmful, offensive, or otherwise in violation of the Terms or any rules or policies Lease by Design has in place at the time.
You agree that we will not upload any Content that may be described in any part by any of the following:
* "Adult", pornographic, obscene, nude, graphically violent, or any other inappropriate Content
* Offers for or the solicitation of prostitution, erotic, or sexual services
* Hate, Racism and/or related
* Pirated software of any kind
* Any material that contains software viruses or spyware
* Anything related to illegal activity, including defamation, threats, or harassment
* We will not Link to any of the above
You agree that you will not use the Email Services to engage in any of the following activities:
* "Spamming" to promote your website or Content or any other practice connected in any way to "spam". You agree that all of your emails will be CAN-SPAM compliant.
* Impersonating any person or entity, including, or falsely stating or otherwise misrepresenting your affiliation with a person or entity
* Stalking, threatening, defaming, or otherwise harassing another
* Forging titles or otherwise manipulating identifiers to disguise the origin of any Content used with Services
* Soliciting personal information, passwords, or other data for commercial, unlawful, unethical, or dishonest purposes
4. FEES
If the Services are purchased by you on subscription basis, the following terms will apply to you. Payments can be paid in U.S. dollars for the Service you have selected. The Services will be deemed accepted by you upon acceptance of this Agreement of the Services and payment of the subscription fees of the Services. Access to the Services will begin after your acceptance of this Agreement and after Lease by Design (or its third party provider) receives and processes all the information, including the credit card or bank account information requested by the registration or ordering process. You must have a valid credit card or a valid debit card acceptable to Lease by Design (or its third party provider) or a PayPal Account start the development of your project. When you subscribe and provide payment information, your Card or bank account will be debited, and will be automatically re-debited monthly. You agree that Lease by Design will not refund any monthly fees.
5. INDEMNITY
By using Lease by Design Services under these Terms, you agree, at your own expense, to indemnify, defend and hold harmless Lease by Design and its affiliates, officers, directors, employees, consultants, agents, suppliers, licensors, co-branders, and other partners from and against any and all third-party claims, liability, damages, losses and/or costs (including but not limited to reasonable attorneys’ fees) arising from or relating to: (a) your failure to comply with these terms of use; (b) your infringement or violation of any intellectual property or other right of a third party; (c) your violation of any applicable law; and (d) your Content, use of Services, Guest activity, connection to Services, or your violation of any other rights of any other party. Lease by Design will not be liable for any of its services. We have the right to cancel our service at any time, and we will not be liable for any files that are lost and/or corrupted which may occur (including, for example, from a system crash, security breach, or hard disk failure). To the full extent permissible under the applicable law, Lease by Design shall not be liable for any direct, indirect, incidental, special or consequential damages resulting from the use or inability to use Lease by Design services.
6. RESALE
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of our Services, use of our Services, or access to our Services without the express written permission of Lease by Design.
7. PROPERTY
All Website and material use to construct by Lease by Design are copyrighted material. Lease by Design websites may not be transferred to or hosted on another web host or Internet Service Provider unless you as the client choose the Buy-Out Option.
8. GENERAL
These terms of use shall be governed by and construed in accordance all Federal and State Laws in Georgia. These Terms of Service constitute the entire agreement between you and Lease by Design with respect to the Service. You acknowledge and agree that you have read and understand the provisions of these terms of use. By using our services, you consent to the terms of service described herein, including any updates. Lease by Design reserves the right to vary these terms of use from time to time.
9. Buy-Out OPTION
At any given time, you will have the option to Buy-Out your website and domain. Your website Buy-Out price will depend on how many pages and features are contained within the website. If you choose to Buy-Out, please contact us and we will send you a proposal. "A typical" Buy-Out price will average $449.00 for a 5 page website ( not including hosting).
